Spellman Openly Questions Consent Agenda Item

According to Darren Spellman he is opposed to the Consent Agenda item before the Board of Supervisors on May 10, 2011:
#4 Minute ORDER authorizing a Refund of Road Impact Mitigation (RIM) Fees in the
amount of $36,568 to Black Creek Ranch LLC; Public Works - Board action:
Stating that this LLC currently has Calaveras County listed as a creditor in their bankruptcy filings, owing the county $147,870.80 in delinquent taxes. 20% unsecured and 80% secured. The following statement made by Calaveras County Treasurer/Tax Collector Barbara Sullivan calls the item into question, “I try to be very proactive when it comes to applying refunds to outstanding delinquent taxes. It makes no sense to refund money when taxes are due.”
Spellman further stated that if the BOS approves this refund, “They will have to explain themselves” to the people.
He also noted that the amount the county has listed on the consent agenda to refund is equal to approximately the operating costs for a full year of the Copperopolis Branch Library. Pointing out that if the county has money to refund to someone who owes back taxes, then they certainly “should have enough to fund a library”.
