Challenging the Fee and Claiming a Refund from the Howard Jarvis Taxpayers Association
You must pay your bill. PAY CLOSE ATTENTION TO THE DUE DATE.
You may have fewer than 30 days to pay. If you are late, steep
penalties and interest are compounded monthly. Moreover, the fee is a
lien on your property, and failure to pay can result in foreclosure.
We at the Howard Jarvis Taxpayers Association believe this fee is really an illegal tax under Proposition 13. We plan to challenge the constitutionality of this tax in court.
Should we prevail, the court may order refunds. To qualify for a refund you must have paid your bill and filed a “Petition for Redetermination” with the responsible agencies.
For convenience, we have posted the form below with the grounds for challenging the fee already filled in. Page 2 contains instructions for completing the form.
When you pay your fee, we recommend that you write “under protest” on the notation line of your check. Also, make a copy of the check so that you can enclose it with your Petition for Redetermination form, as proof of payment.
Although only one address appears at the bottom of the form, state law actually requires that you submit the form to three different addresses. You must submit it WITHIN 30 DAYS OF THE DATE OF YOUR BILL to the three addresses below:

Governor Edmund G. Brown Jr. today announced that he has signed
legislation to help California’s college and university students and
improve higher education throughout the state.

Governor Brown Signs Laws to Protect Privacy for Social Media Users
Governor Edmund G. Brown Jr. today took to Twitter, Facebook, Google+,
LinkedIn and MySpace to announce that he has signed two bills that
increase privacy protections for social media users in California.
Assembly Bill 1844 (Campos) and Senate Bill 1349 (Yee) prohibit universities and employers from requiring that applicants give up their email or social media account passwords.
“The Golden State is pioneering the social media revolution and these laws will protect all Californians from unwarranted invasions of their personal social media accounts,” said Governor Brown.

Measure C press release
PRESS RELEASE
COPPEROPOLIS
FIRE PROTECTION DISTRICT
MEASURE
C
Statement
of Facts
The Copperopolis
Fire Protection District has placed Measure C on the November Ballot. This Measure is to re-affirm the District’s
Appropriation Limit, also known as the Gann Limit. This ballot measure requirement comes from
legal language that is still in place from the property tax movement of the
late 1970’s and early 1980’s.
MEASURE C IS NOT
AN INCREASE IN TAXES OR FEES
Measure
C is not a new tax. It is simply a re-authorization to allow the Copperopolis
Fire Protection District to spend the revenues from taxes that were already
approved in 1997 and 2002 by more than 2/3 of the voters within the District. Measure C is not a new tax or a tax
increase. By approving Measure C, your
taxes will not be increased in any way, but the Copperopolis Fire Protection
District will be allowed to spend the taxes that have already been approved and
collected. Article XII(b) of the
California State Constitution requires the voters approve this Measure every
four years.
The Gann
Limit prohibits the District from spending tax revenue that equals more than
the approved limit, thus restricting growth, and sometimes reducing tax-funded
programs and services.
If
Measure C is not passed, the Copperopolis Fire Protection District will be
unable to spend some of the tax revenues collected each year. This may mean the loss of the paramedic
services and the potential loss of firefighter positions. As a result, residents might have to wait for
up to 30 minutes for a paramedic response.
MEASURE
C IS NOT A NEW TAX. A YES vote on MEASURE C will allow the Copperopolis Fire
Protection District to spend the tax revenue that you have previously approved
and assist in maintaining the level of protection it provides to the community.
If you have any questions
regarding Measure C, you may contact the Fire Station at 209-785-2393.

Rico Oller Opposes Fire Tax on Rural Property Owners
SAN ANDREAS, CA – Rico Oller (R-San
Andreas), candidate for Assembly, today restated his opposition to recently
assessed annual fire fee (SRA fee). Rural property owners in California’s
foothills and mountains insist it is a tax and an illegal one at that.
Oller supports a lawsuit by the
Howard Jarvis Taxpayers Association declaring the assessment on property an
unconstitutional tax under the 2/3rds voting requirement of Proposition 26.
To make up for budget cuts at
California Department of Forestry and Protection, the Democrat Legislature
passed, with a simple majority vote, a bill intending to raise $84 million by
charging 825,000 property owners in one third of the state up to $150 a
year.

Sierra Rep presents 'Time Stands Still'
New play captures the hard angles of love, war and life transitions
As a seasoned photo journalist, Sarah Goodwin has made her
living looking through a lens, freezing moments of heartache, horror and
humanity in the war-torn corners of the globe. She and her long-time partner,
combat reporter James Dodd, have always shared a deep commitment to their work.
So when a
roadside bomb in Iraq sends
her home to New York
for months of painful recovery, both are reeling from the trauma. In witty,
engaging conversation, the couple gingerly explores this new direction their
lives have taken, not sure what it’s revealing. Can they recover from the
wounds and adjust to a more conventional life? And should they?

Missing Moke Hill Man located
On 09/25/12 at approx. 9:42 AM the Calaveras Sheriffs Office
located the 79 year old Duane Gates. The Sheriff s Office received a phone call from a
resident in the Boston Yale subdivision stating that they had located Mr. Gates.
Paramedics, firefighters and sheriff s deputies responded to the bottom of a small hill in
the subdivision where Mr. Gates was located. He was conscious and aware, but unable to
provide a statement to investigators. On 09/24/12 search and rescue team members,
search dogs, and a helicopter searched this area, but found no sign ofMr. Gates. The
investigation so far points towards Mr. Gates having walked away from his home to an
unknown destination on or about 09/23/12. He then likely returned to the area during the
night of 09/24/12, where he was found this morning approx. 1/4 mile from his house. Mr.
Gates was taken to a Modesto area hospital for evaluation and treatment of an injury to
his arm (no further information will be released on the injury). Calaveras Sheriffs
Detectives will interview Mr. Gates at a later date to determine the circumstances behind
his disappearance. There is no evidence that foul play is involved.

Sonora PD press release re: Burglary arrest
22 September 2012, at approx. 7:54 pm, Officers responded to Safeway
located at 1291 Sanguinetti Road regarding a push out of groceries.
When Officers arrived they contacted store employees. The employees related that a male and female subject, who had a child with them, entered the store and filled two shopping carts with groceries and then pushed the shopping carts past all the cashiers without paying for the groceries, which was captured on the stores surveillance cameras.
When employees discovered what had occurred, they attempted to contact the subjects in the parking lot. However, the subjects speed away after loading all the groceries and child into their vehicle. In their rush to leave the parking lot, an open passenger door scraped the vehicle they were parked next to.

In their rush to leave the parking lot, an open passenger door scraped the vehicle they were parked next to.
John Campanella's 'Rock Show' ROCKED the town
At the Town Square September concert series concert on September 22, 2012 John Campanella's 'Rock Show' Rocked the town of Copperopolis. Rock lovers, young and old alike, gathered to hear and see the music of the '80's performed with enthusiasm, talent and panache by John and his back up singers, wife Dana and friend Martha Lane.
Though staying true to his heart and his passion for mentoring youth, John's 'Rock Show' was opened by many local youth bands playing their own style of rock and roll. The bands were diamonds in the rough with talent, drive, and above all a passion for music. This venue was the perfect setting for these young aspiring musicians to 'cut their teeth' and perform before a live audience of varying ages and backgrounds.
High energy was served in heaping helpings this evening as the music moved people to dance and sing and the children to run and play. The energy was palpable and contagious. Not to mention the array of '80's themed dress for the evening...a fun night for the whole family!
