BOS votes 5-0 in favor of Calaveras Country Club Specific Plan (Saddle Creek) extension

Agenda item 13 on the Board of Supervisors 10-14-14 agenda stated: The Planning Commission recommends that the Board of Supervisors find that the project is exempt from CEQA under Government Code Section 65457 and pass a motion authorizing the Chair to sign an Ordinance extending the expiration of the Calaveras Country Club Specific Plan (Saddle Creek) Development Agreement for a period of five years, to June 13, 2019.

The ordinance passed 5-0. 

Dave Haley, of Castle and Cooke addressed the Board explaining the request due to an "8 year serious economic downfall" yet pointing out that during that time Saddle Creek saw "50% of lots developed, which is beneficial to our County."

Local resident Jane Everett questioned whether this action included information or possible inclusion of the rumored 2nd access and egress planned on Copper Cove Drive and Little John Road and the question of whether a 'roundabout' to access Saddle Creek would be imminent.

Haley said he would address this issue with the homeowners association at their 10-16-14 Board meeting.

Supervisor Ponte asked if this issue would also be coming before the Board. Haley confirmed that it would.

The CCLTOA Board meeting to address the potential 2nd access and egress to Saddle Creek at Copper Cove and Little John, will be held at Black Creek Park at 6 pm on 10-16-14.

CCLTOA HOA meeting - agenda item on guns a non-issue

At the 3-20-14 CCLTOA HOA board meeting a line item titled "Guns Issue on Association Common Areas Property" was quickly put to rest by the Board.


"This was blown way out of proportion," said board member Julie Betz, remarking that it had gone too far. Many of the Board members were in agreement.

According to Rob Adamson, each issue brought to the Board is looked into, this issue was discussed at the study session earlier this week and the board "concluded that no additional action is needed and none will be taken at this point."

President, Doug Rockey supported that decision and pointed to the fact that the lake was a "hunting and fishing lake" whereby it was legal for those legally carrying guns to possess them on the lake and therefore property owners within the HOA had a right to access and egress with their boats through the Kiva docks carrying said licensed firearms. Furthermore he pointed to the legalities of CCW permits allowing those who are permitted to carry concealed on common areas.

CCLTOA visits possible gun restrictions in common areas

Item d) on the CCLTOA agenda for 3-20-14 states: gun issue on association common areas property.

In response to Copper Gazette's questions  regarding the agenda item, Rob Adamson, board member, responded:
"The issue you reference was brought up during an Executive Board meeting when it was brought to our attention that an individual was on a CCLTOA common area property with a concealed weapon. CCLTOA Common Area properties would include Black Creek Park, The Kiva and the Equestrian Park located off Little John Road.  The individual in question has a legal registered concealed carry permit and was lawfully carrying a gun. The individual who in the presence of the person in possession of the weapon brought it to the attention of the Board. As in all matters that are raised as concerns by any of our Association members it is our responsibility as a Board to address them once brought before us and we did so. In the interest of time during our Executive meeting I suggested that we continue the discussion at our study session meeting that was held last evening for consideration of any further action. The issue was discussed and it was concluded that no additional action is needed and none will be taken at this point.'
 
The issue will still, however, be discussed in open forum at the 3-20-14 board meeting and the board will submit their findings.

Court rules in favor of CCLTOA awarding $18,540 plus costs

The award stems from a lawsuit brought against the association by Marilynn Meyer that was later dismissed by Ms. Meyer.


Update:
1-10-14
Sources state that Mr. Meyer, attorney for Marilynn Meyer, has stated that he is planning on filing a motion to vacate the order and file another malicious prosecution action.
When contacted, Mr. Meyer had no comment.

CCLTOA voter results

Four people vied for three seats on the Copper Cove Lake Tulloch Homeowners Board recently with the voter outcome as follows:
Rob Adamson - 500 - elected
Doug Rockey - 488 - elected
Julie Betz - 430 - elected
Marilyn Meyer - 199 - Not elected.

According to representatives within CCLTOA the million dollar lawsuit filed earlier this year by the Meyers against CCLTOA board members and volunteers alleging malicious prosecution has been dismissed. CCLTOA is suing the Meyers for $18,000 in attorney fees.

Update 8-23-13, 9:17 am:
Thomas Meyer contacted the Gazette via email and stated that "We are AGAIN suing CCLTOA for Malicious Prosecution asking for 1.3 Million."

Short Term Rental = Short tempers at BOS meeting

At the 2-12-13 Board of Supervisors meeting the issue of Lake Tulloch vacation rentals was visited once again.

The previous vote of 4-0 (Callaway absent) to adopt the ordinance requiring short term rentals being permitted went back to the drawing board at the Planing Department for some changes in language including but not limited to : exempting Driftwood Townhomes from the as they have no public access to the lake; visit the capacity of a home for vacation rental, possibly utilizing square footage in lieu of the current factor that allows 2 persons per room; change the title of the ordinance to Regulations for County Areas - not only Lake Tulloch. This re-opened the ordinance to more discussion.

Multiple citizens chose to speak to the issue.
