At January 27, 2011 CFPD Board of Directors meeting Per Diem (part time) Paramedic Kelly Zook requested his per diem status be commuted to that of a full time employee. The request was made in a letter that left the Board asking if they had been handed an ultimatum.
The following is a clip from a Copper Gazette article written January 28, 2011 with regards to the CFPD Board meeting January 27, 2011 and Paramedic Zook: Following the adoption of the MOU, part-time paramedic Kelly Zook requested that a letter he had submitted to only two of the five Board members (Chairman Maness and Vice Chairman Marks) be placed on the agenda for action at the following meeting. The letter states that “in light of Captain Robataille’s resignation” he can and will offer his skills and services to the District if by February 2, 2011, he receives employment as a full time employee, approval for 6 vacation periods, a substantial raise, and a waiver of the customary probation period. He also listed his many attributes and qualifications to complete the vacancy created by Robataille. When asked by Chairman Maness what would happen on February 2, 2011…”Are you giving us (the Board) an ultimatum?” Zook stated that he had conferred with his family and, if need be, would take some kind of action. Zook said he would either walk away from his per diem duties or his position completely. Maness acknowledged Zook’s statement and moved on. After the meeting Director Maness was asked how he felt the Board would deal with Paramedic Kelly Zook's letter, he stated, "The Board does not entertain ultimatums."
Zook had said he had given the letters to the Board under advisement by his attorney. With no attorney name mentioned, it was made known that he was a voting member of the CDFA (Copperopolis District Firefighters Association) …the fledgling Union…but does not have the exclusive representation offered by the Union that a full time employee receives.
On February 3, 2011 with the deadline passed, the Chief stated that Zook currently remains a per diem, under no obligation to stay. Yet that “he is a committed per diem paramedic with CFPD.”
When asked if Zook’s letter would be on the agenda for the upcoming Board meeting, Chief Cantrell stated that he was still waiting for word from the Chairman concerning that issue.
CFPD Board Chairman John Maness submitted this statement after being questioned whether Zook’s letter would be on the agenda and addressed by the Board. “On Thursday night the Board will consider for adoption a draft policy that standardizes our examination process for the selection of new hires. The draft pre-dates Mr. Zook’s recent proposal to the Board and he is welcome to participate in whatever selection process we adopt.”
The next CFPD Board meeting is scheduled for February 10, 2011 6:30 pm Station #1.
