JURY FINDS MAN GUILTY IN THREE STRIKES CASE

People v. Robert Swiggart, 14F6178

On Tuesday a Calaveras County jury convicted a Stockton man, Robert Swiggart, of four felonies with two strike priors, four prison priors and one misdemeanor.  The felonies include criminal threats, inflicting injury on Jane Doe a co-habitant, attempting to extort $5,000, and stalking of Jane Doe after a restraining order was issued against him.

Deputy District Attorney Dana Pfeil was pleased with the outcome.  She said “the victim (Jane Doe) showed real courage after testifying for an entire day.  Domestic violence cases can be difficult because there is a stigma attached to the crime.”  In the middle of the trial the Defendant decided to represent himself, as is his Constitutional right, so the Public Defender’s Office was relieved.  Three Deputy Sheriff’s testified in the case in addition to three lay witnesses.  Dana Pfeil said “Justice was served and a career criminal will be out of our community.”

The two “strike” prior convictions were for two separate burglaries of an inhabited dwelling in 1994.  The Defendant could receive twenty-five years to life in prison due to the two strike priors and possibly more time for the remaining felonies.  A sentencing hearing is set for August 5th.  The Probation Department is expected to file a report and recommend a sentence.

The victim wished to be listed as a Jane Doe in court documents.

The Sound of Music comes to the Fallon House

The foothills will come alive with The Sound of Music when the classic Rodgers and Hammerstein musical returns July 11 through August 31 at Sierra Repertory Theatre’s historic Fallon House Theatre in Columbia.
The delightful musical – based on the true story of the von Trapp family in Austria – has been captivating audiences for more than half a century, drawing huge crowds when it first hit Broadway and appearing again six years later as a much-beloved film.
After 55 years, the show’s appeal is still universal, Sierra Rep’s Artistic Director Scott Viets said.
“There’s something special about The Sound of Music,” said Scott Viets, Sierra Rep’s artistic director, who directs the show. “Seven children singing and dancing, a love story, nuns, villains, an exotic setting – Austria in the 1930s – and that incredible musical score.”

4th of July Celebration in Angels Camp a wonderful tribute to veterans, families and freedom!

The Angels Camp Business Association 4th of July Celebration held in Utica Park had the all the makings of a fabulous community celebration.

The Det. 1 40th Infantry Division Band "The Governor's Own" played patriotic music of all eras brilliantly and to the delight of all.

The crowd stood with respect as the ceremony began with the James D Piper VFW Post 12118 Honor Guard performing the call to colors with skill and palpable pride.

The National Anthem, sung by Leah Callahan, was sung beautifully,

followed by a blessing and the reading of the Declaration of Independence. A must read for all citizens.

When it came time to honor veterans, Master of Ceremonies Captain James Dodge, USN Ret, was pleasantly surprised with the more than 10 pages of veterans submitted. Over 100 names were read, with their dates of service and medals earned.

Flags representing each branch of the military were held by members of VFW Post 12118, when one flag was stepped forward, veterans in the crowd who served in that branch would stand and be honored while the anthem for that branch was played by the band.

Veterans from WWII, Korea, Vietnam, Aleutian Island campaign, Panama, Granada, Iraq, and Afghanistan were represented.

Community Garden clean up

Remembering Rick Nelson's song, "Garden Party", we'll get together tomorrow night to 'have at' the Morning Glory and try to figure out what's happening to the irrigation on Chaitan's Oak Tubs.

Oak Tubs - the central tub has standing water when the drip irrigation is on, so clearly it is 'stealing' water from the other two tubs.

Morning Glory - yes, it is bad and we need to "get physical" in order to give the tomatoes a chance to set their flowers.   We also should give them some calcium, to stave off blossom end rot - I do believe we have what is needed in the shed.

Beans - need to be picked, so bring a basket to take some home.  And the Morning Glory is no less aggressive on that end (north) of the garden.

I do appreciate all who've spoken with me to let me know they will attend.   Thank you for your support.

New Melones Fishing Report from Glory Hole Sports

7-7-14 Fishing Report

Water Conditions:  New Melones Lake is currently holding
694,364 acre-feet of water.  The lake level dropped four feet this week and is currently at 895 ft. above sea level and 190 ft. from full.  The water is stained in most areas of the lake, and fairly clear in others.  There are mud lines forming near the shore throughout the day, especially on windy days. The average water temperature is 74-80 degrees and rising daily.  Tuttletown launch is closed. Glory Hole Point boat launch is open, and there are no plans to close it. There will be some transition periods between launches where launching will be limited to one or two lanes.

Trout: Fair.  The trout are roaming the main lake near deeper/cooler water looking for balls of shad.  Anglers should try fishing close to the surface in the early morning and evening and dropping to 40-60' during the day.  Night fishing anglers are catching limits of fat healthy trout under a submersible light.   Try anchoring the boat in 25-50' of water, and dropping the light 15-25' feet down.  Be patient, it may take awhile for the light to attract plankton, baitfish, and trout.  To catch them, try using live minnows, mini jigs, Power Bait, and crawlers. Trolling anglers should target trout in the main lake, near deep water.  The trout are feed on 2-4" shad.  Try using baits that match the size, profile and color of the baitfish.  Rapala Shad Raps, Scatter Raps, Rattle traps, and Jointed Shad Raps are a very close match to the natural forage.  Another way to get a few more bites is to add scent to your lures.  Pro Cure gel in shad scent, or threadfin shad scent will do the trick.  Don't forget to bring some crawlers.  A single crawler threaded on the hook fished behind a single gold or silver blade is a great way to pick up a few fish.  Bank anglers should try using a bubble and a fly rig in the mornings and evenings.  Or soak some night crawlers and Power Bait midday.  Also, try fishing some other local lakes and streams.  Fly Fisherman, head to rivers, streams, and creeks.  Try using nymphs and buggers midday.  Switch a dry fly for some evening surface activity.   We do encourage catch and release for the brown trout as The Department of Fish and Game will no longer be planting them.  Carefully measure, weigh and photograph trophy fish and send us pictures and information.

Ron Lubin and Jim Fox enjoyed a day of kokanee fishing and brought in two limits.

Bark and Bubbles asks you not to leave your dog in a hot car

PLEASE DON’T  LEAVE YOUR DOG IN THE CAR!
BARK N BUBBLES (NEXT TO IGA) WILL BABY SIT FOR FREE WHILE YOU SHOP IN OUR PLAZA

“Often people leave their dogs in the car while they shop or run errands, but doing so when the weather is warm can literally be a death sentence for your pet,” said UAN President and CEO Nicole Forsyth.Forsyth offered five reasons why leaving a dog in a hot car can be deadly:
1. Dogs are especially vulnerable to heat-related illness because they can only cool off by panting and through the pads in their feet.
2. Even on seemingly mild days, an enclosed car can be deadly. In a Stanford University study, when it was 72 degrees outside, a car’s internal temperature climbed to 116 degrees within one hour.
3. Enclosed cars heat up quickly. In a study by San Francisco State University, when it was 80 degrees outside, the temperature inside a car rose to 99 degrees in 10 minutes and 109 degrees in 20 minutes.
4. A dog’s normal body temperature is between 101 to 102.5 degrees; a dog can only withstand a high body temperature for a short time before suffering nerve damage, heart problems, liver damage, brain damage or even death.
5. Studies show that cracking the windows has little effect on a car’s internal temperature.
