Power Struggle about layoffs at SO Continue

According to Supervisor Spellman, Sheriff Gary Kuntz has been more than patient with the BOS (Board of Supervisors) regarding the ongoing power struggle over who has the right to issue layoffs notices within the Sheriff Department. When asked who has the final authority for layoffs within his department, Kuntz replied, "It depends on who you ask, but I do." Paperwork from the Deputy Sheriff Association also claims the authority lay with Kuntz.

"The BOS has chosen not to listen to the Deputy Sheriff Association" said Spellman, furthering the "peacocking." Yet, Spellman said, "I give Kuntz full credit for trying to do the right thing" explaining that Kuntz has almost exhausted all the civil paths to solving this dilemma, adding that the BOS do not have the legal authority to give pink slips.

According to Spellman, the Board of Supervisors determines budgets but the elected official department head of a department has the authority to layoff employees to adhere to a projected or real budget cutback.
